Ques 101  State the various articles of the Constitution of India which have been referred in the Pb. CSR’s?

Ans 101 As per Appendix-1of CSR Volume-1 part – II, articles Numbers 16, 187. 229, 309, 310, 311 and 318 of the Constitution of India have been referred in the Punjab Civil Service Rules.

Ques 102   Punjab Education Department has made separate merit lists of male and female candidates for filling the vacant posts and issued appointment orders in the ratio of 60:40 Comments?

Ans 102                The action of the Education Department is violation of Article 16 (2) of the constitution of India vide which no citizen can be discriminated on the ground of sex. (Appendix-1 C.S.R Volume-1 part II).

Ques 103  The Govt. of India issued notification for reserving 27% of the posts in the Govt. service for Backward classes. Comments?

Ans103  The action of the Govt. of India is in accordance with provisions of 16(4) of the Constitution of India vide which Govt. can make provisions for reservations in appointments in favour of Backward classes. (Appendix-1 C.S.R Volume-1 part II).

Ques 104 There is Secretariat of State Legislature in addition to the Punjab Govt. Secretariat. Comments?

Ans104  Article 187(1) of the Constitution of India provides that there shall be separate Secretariat staff for the House of State Legislature. (Appendix-1 ESR Volume-1 part II).

Ques 105. Who is the Competent Authority for appointment of officers and staff of the High Court of the State?

Ans 105 Article 229(1) of the Constitution of India provides that the Chief Justice of the High Court or any judge or any officer of the Court as directed by the Chief Justice will be the Competent Authority for appointment of officers and staff of the High Court. (Appendix-1 CS.R Volume-1 part II).

Ques 106 State whether the administrative expenses of the High Court are considered as Voted expenditure or Charged. Whether such are born by the Govt. of India or State Govt?

Ans 106 Article 229(3) of the Constitution of India lays down that the administrative expenses of the High Court are considered as Charged expenditure and these are borne by the State Govt. (Appendix-1 C.S.R Volume-1 part II).

Ques 107 Who is the Competent Authority to make rules regulating recruitment and conditions of service for the employee of the State?

Ans 107 As per provisions of Proviso to article309 of the Constitution of India the Governor of the State or any such person as directed by the Governor is Competent Authority to make rule regulating recruitment & conditions of service for the employee of the State. (Appendix-1 CSR Volume-I part II).

Ques 108  Please state the tenure of office of person (employee) serving the State Govt.

Ans 108 Article 310(1) of Constitution of India lays down that every person who is a member of service of the State Govt hold office during pleasure of the Governor of the State (Appendix 1 CSR Volume I Part II)

Ques 109 A person was appointed by the State Govt. for a period of five years. After two years the post was abolished, the person concerned asked for compensation for the remaining period of three years Comments?

the Constitution of India vide which if the post is abolished before the expiration of the agreed period he is entitled to compensation. (Appendix-1 CSR Volume-1 part II)

Ques 110  A Constable was appointed by the I.G. Police Pepsu the then Appointing Authority for a constable. The SSP being now Appointing Authority dismissed the constable. Comments?

Ans  The action of S.S.P. is against the provision of the 311(1) of the Constitution of India vide which no employee can be dismissed by an authority subordinate to that by which he was appointed.

Ques 111 An employee was dismissed by the Competent Authority. He appealed that he was not given a reasonable opportunity of being heard and no departmental enquiry was held. Comments?

Ans 111 The appeal of the employee is in accordance with the provisions of article of 311(2) of the Constitution of India vide which no employee can be dismissed without holding an enquiry and giving a reasonable opportunity of being heard to him except in the interest of the security of the State.

Ques112   Please State the Circumstances under which the employee of the State Service can be dismissed without holding enquiry or giving a reasonable opportunity to be heard?

Ans. 112   As per the provisions of article of 311(2) of the Constitution of India, an employee can be dismissed without holding an enquiry in the following circumstances: –

  1. If we was convicted in a criminal charge or
  2. Where the Competent Authority is satisfied that it is not reasonably practicable to hold the enquiry, or
  3. The Governor of the State is satisfied that it is in the interest of the security of the State not to hold such enquiry,

Q113     A Competent Authority dismissed an employee without holding an enquiry on the ground that it is not reasonably practicable to hold enquiry. Please State such a decision of dismissed can be challenged?

Ans 113  Article 311 (3) of the Constitution of India lays down that the decision of the Competent Authority in such a case is considered as final and is not challengeable.

Que14   Please state that who is the Competent Authority to fix the number of the Punjab Public Service Commission member and their conditions of service?

Ans Article 318 of the Constitution o India lays down that the Governor of the State is Competent Authority to fix the number of the members of Punjab Public Service Commission and their condition of service.

Que15   Mr. A was appointed as member of the FPS.C for a period of six years After two years the State Govt changed the condition of his service to be disadvantageous to him. Comments?

Ans  The action of the State Govt was against the provisions of prover to article 318 of the Constitution of India, vide which the condition of the service of the member of Public Service Commission shall not be changed to his disadvantage after his appointment
