Ques 417. Mrs. A was appointed as Data Entry Operator in Excise & Taxation Department at a fixed salary of Rs. 3.000/- P.M. on 1.4.1994. She was allowed the regular scale of clerk 3,120-5,160 with minimum of 3,220/ after ten years i.e., on 1.4.2004. Fix his pay on 1.4.2004 & find out her date of next Increment.

Ans 417.  Vide note 3 below rule 4.6 of CSR Vol-1, Part-I, her pay on 1.4.2004 will be fixed at the minimum of the regular scale i.e., 3220/- (without regard to her ten years’ service on fixed salary. She will get her next increment w.e.f 1.4.2005 raising her pay to Rs. 3,330/-.

Ques 418. Whether increment is to be drawn as a matter of course? (DTO 12/01) (5)

Ans 418. Under rule 4.7 of CSR Vol-1, Part-1, an increment shall ordinarily be drawn as a matter of course, unless it is withheld by a Competent Authority if employee’s conduct has not been good or his work has not be satisfactory?

Ques 419. State the circumstances under which increment of a Government can be withheld?

Ans 419. As per rule 4.7 of CSR Vol-1, Part-1, increment of a Government employee can by withheld by a Competent Authority, in the following circumstances: –

  • His conduct has not been good or
  • His work has not been satisfactory

after following the procedure laid down in the Punjab Civil Services (Punishment & Appeal) Rules, 1970.

Ques 420. Whether Increment of an employee can be withheld by the Head of Office?

Ans 420. Under rule 4.7 of CSR Vol-I, Part-I, an increment shall ordinarily be drawn as a matter of course unless it is withheld by the Competent Authority for misconduct or unsatisfactory work and also after following the procedure as laid down in the Punishment & Appeal Rules, 1970.

Ques 421. Who is the Competent Authority to withheld increment of an employee?

Ans 421. As per provisions of Serial No. 18 of rule 15.1 of CSR Vol-l, Part-1, the authority specified in the Service Rules or the Appointing! Authority is competent to withhold increment of an employee the authority specified in the Service Rules or the Appointing Authority, is competent to withhold increment of an employee.

Ques 422. As per Service Rules of PWD, a clerk having three years service can be promoted as Assistant. An employee having two years service as clerk qualified the Assistant Grade Examination and was promoted as Assistant by the Competent Authority, due to scarcity of qualified personnel. How his pay will be regulated?

Ans 422. The pay of such an employee will be regulated vide note below rule 4.7 of CSR Vol-1, Part-1, vide which on promotion he will get minimum of the time scale of Assistant. He will get his first annual increment as Assistant after two years (i.e. after one year from the date of the completion of the minimum length of qualifying service necessary for the appointment to the post of Assistant, as per Service Rules.

Ques 423. An Officiating Section Officer was promoted as Officiating Assistant Controller (Finance & Accounts) on 9.9.1989. Whether his pay is to be fixed under rule 4.4 (c) (i) of CSR Vol-1, Part-1?

Ans 423. The pay of the Officiating Section Officer, on promotion as Assistant Controller (Finance & Accounts) on 9.9.1989, will not be fixed under rula 4.4 (c) (i) of CSR Vol-l, Part-1. His pay on promotion will be fixed under rule 8 (1) of Revised Pay Rules, 1988, by giving him benefit of two increments considering that he has not earned Proficiency step ups as officiating Section Officer.

Ques 424. Upto which date, the pay on promotion of a Government employee, was to be fixed under the provisions of rule 4.14 (1) r/w 4.4 (a) (1) i.e. substantive to officiating or 4.4 (c) (1) 1.e. Officiating to Officiating.

Ans 424.  The pay of a Punjab Government employee on promotion is to be fixed under the provisions of 4.14 (1) r/w 4.4 (a) (1) i.e. substantive to officiating & 4.4 (c) (i) i.e. Officiating to Officiating up to 31.12.1985. Thereafter i.e. from 1.1.1986 onwards the pay on promotion is to be fixed under the provisions of Rule 8 (1) of Revised Pay Rules, 1988 by giving him benefit of two increments if he has not earned proficiency step up in the lower post.

Ques 425. Whether rule 8 (1) of Revised Pay Rules, 1988, under which benefit of two increments is allowed on promotion of an employee, is effective from 14.9.88 or 1.1.1986 ?

Ans 425. The State Government vide circular letter No. 6/292/92-IFP-11/3745-49 dated 16.5.1996 had clarified that Rule 8 (1) of Revised Pay Rules, 1988, which gives benefit of two increments on promotion is effective from 14.9.1988 l.e. after the date of publication of Revised Pay Rules, 1988. However, the employee promoted to the higher posts during 1.1.1986 to 13.9.1988 may also be fixed notionally under the provisions of Rule 8 (1) by giving benefits of two increments but arrears may be paid from 14.9.1988 if the employee was in service. In case the employee had retired before 14.9.1988 his pay may be fixed notionally & pension revised but arrears of pay/pension may be paid from 14.9.1988.

Ques 426. Please state the date on which proviso (a) & (b) was added to Rule 8 (1) of Revised Pay Rules, 1988 and the date from which It has been made effective?

Ans 426. Also state how pay of a Government employee is fixed If he opts Proviso (a) or (b) for fixation of his pay on promotion. Proviso (a) & (b) was added to Rule 8 (1) of Revised Pay Rules, 1988, vide Punjab Government notification No. 6/160/89-FPII/4380 dt.15.5.90. The date from which it has been made effective is 14.9.1988.

If an employee, on promotion, opts Proviso (a) to Rule 8 (1) & he has not earned Proficiency step up, he is entitled to two Increments, However if he has already earned Proficiency step up in lower post, he is entitled to one increment. In both cases he will get increment after 12 months.

If the employee opts Proviso (b) & he has not earned Proficiency step in lower post, he is entitled to one increment on the date of promotion, It may be revised later by providing the benefit of two raises in the higher post’s pay scale on the date of the next raise in the lower post’s pay scale.

However if he has already earned Proficiency step up in lower post, He will receive one increment on the day of promotion and another one on the day that the next increase in the scale for the lower job becomes accrued.

Ques 427. Please state the date on which the Proviso (a) & (b) to Rule 8 (1) of Revised Pay Rules, 1988 were deleted and its effective date. What will be its repercussions?

Ans 427. State Government vide notification No. 6/160/89-FPII/975 dt.15.1.2003 deleted proviso (a) & (b) to Rule 8 (1) of Revised Pay Rules, 1988 & its effective date is 21.1.2003.

Due to deletion of above provisions, the employee will earn increment after 12 months from the date of promotion irrespective of the fact that he has received one increment or two increments on promotion.
