PUNJAB GOVERNMENT EMPLOYEES ((CONDUCT)) RULES1966

Ques 2301 Please state whether Punjab Govt. Employee ((Conduct)) Rules1966, are applicable of ALL INDIA SERVICE/IPS Officers working under the Punjab Govt.

Ans 2301 Vide proviso (a) to rule 1(3) of the Punjab Govt. Employees (Conduct) Rules1966, these rules are not applicable to ALL INDIA SERVICE/IPS Officers working under the Punjab Govt.

Ques 2302 A Govt. employee was transferred temporarily to Govt. of India. Please state whether Pb. Govt. employees (Conduct) Rules, 1966, are applicable or not during the period of temporary transfer?

Ans 2302 Vide proviso (c) to rule 1(3) of the Punjab Govt. Employees (Conduct) Rules 1966, the employee during his temporary transfer will be governed by the corresponding rules to the Govt. of India, during the period of his temporary transfer.

Ques 2303 A Punjab Govt. employee was sent on deputation to Chandigarh U.T.Govt. Please state whether (Conduct) rules of Chandigarh. U.T.Govt. or Pb.Govt. Employees (Conduct) Rules,1966, will be applicable to him during the period of deputation?

Ans 2303 Vide proviso (c) to rule 1(3) of the Govt. Employees (Conduct) Rules1966, during the period of deputation the corresponding Conduct Rules of Chandigarh. U.T.Govt. will be applicable.

Ques 2304  A Punjab Govt. officer was sent on deputation to PRTC Patiala. Please state whether Pb. Govt. Employees (Conduct) rules, 1966,, or PRTC Employees Conduct Rules will be applicable to him during the period of deputation?

Ans 2304  Pb. Govt. Employees (Conduct) Rules1966 will be applicable to officer during the period of deputation to PRTC vide explanation below rule 2(b) of the Rules.

Ques 2305 Who is the Competent Authority to grant permission to class III employees under the Pb. Govt. employees (Conduct) Rules,1966?

Ans 2305  Vide rule 2(d)(iii) of the Punjab Govt Employees (Conduct) Rules 1960, Head of Office is the Competent Authority to grant permission to class III employees under the Pb Govt. Employers (conduct) Rules.

Ques 2306 A Punjab Govt. officer was sent on deputation to PRTC Patiala. He wants to purchase a second-hand car, whose sanction will be required under the Conduct Rules?

Ans 2306 Vide rule 2(d)(b) of the Punjab Govt. Employees (Conduct) Rules.1966, sanction of the Parent Department on the cadre of which the employee is borne will be required in this case.

Ques 2307 A supervisory officer claimed that he is honest and devotes full time to his duty but his subordinates are lazy and corrupt. Comments?

Ans 2307 The claim of the officer is against the provisions of rule 3(2)(1) of the Punjab Govt Employees (Conduct) Rules 1966 vide which it is the duty of the supervisory officer to take all possible steps to ensure the integrity and devotion of duties of all employees under his control and authority.

Ques 2308 A Head of Deptt. while on tour issued oral directions to his district officer. The District Officer carried out the directions and sent a communication to the Head of Deptt. to confirm his oral directions. The Head of Deptt. wrote back that there was no need for confirmation in writing of his oral directions while on tour. Comments?(SAS9/89)

Ans 2308 The action of the Head of Deptt. is against the provision of rule 3(2)(ii) of the Punjab Govt. Employees (Conduct) Rules1966, vide which written confirmation of the oral directions is required to be sent by him as soon as possible.

Ques 2309 A Head of Deptt. on a visit to a district asked his District Officer orally to transfer a particular employee. The District Officer did not comply with oral orders. The Head of Deptt. instituted/started departmental action against the District Officer. Comments?

Ans 2309 The action of the Head of Deptt. in initiating the departmental action against the District Officer for non-compliance of oral directions regarding transfer is against the provision of explanation II below rule 3(2) of the Punjab Govt. Employee (Conduct) Rules, 1966.

Ques 2310 An officer of the Industry Department used his influence to secure employment of his son in an industry in Punjab. Comments?

Ans 2310 The action of the officer is against the provision of rule 4(1) of the Punjab Govt. Employees (Conduct) Rules,1966, vide which no employee can use his influence or position to secure employment for any member of his family in any company or industry.

Ques 2311 A dependent brother of a class-I officer accepted employment in a company with which his brother has official dealings, Comments?

Ans 2311 The action of the officer is against the provision of rule 4(2)(1) of the Punjab Govt. Employees (Conduct) Rules,1966, vide which he should have not permitted his brother to accept employment without obtaining prior permission of the Govt. or should have accepted employment provisionally subject to the Govt. permission vide proviso below the rule.

Ques 2312. A Govt. employee intimated to the state Govt. that his son has accepted an employment on merits in a company with which he has official dealings. Comments?

Ans 2312. The action of the Govt. employee is in accordance with the provision of rule4(2)(ii) of the Punjab Govt. Employee (Conduct) Rules 1960. vide which intimation to the prescribed (competent) authority is necessary in such cases.

Ques 2313. A son of a Govt. employee brought up by the mother, judicially separated from the Govt. employee gets a job without using his father’s name, position or influence in a firm, which has official dealings with the Govt. employee. Comments?

Ans 2313. Vide rule 2(c) (ii) of the Pb. Govt. Employee (Conduct) Rules,1966, the son in question does not fall in the term of the family of the employee. As such son’s getting a job in the firm is in order.

Ques 2314. A Pb. Govt. officer sanctioned a contract to a company in which his son is working as Director after following the official procedure. Comments?

Ans 2314. The action of the officer is against the provisions of the rule 4(3) of the Pl Govt. Employees (Conduct) Rules,1966, vide which he should have got approval of his official superior before sanctioning the contract.

Ques 2315. A Govt. employee was selected General Secretary of the city of a Political Party. Comments?

Ans 2315. The action of the Govt. employee is against the provisions of the rule5(1) of the Pb. Govt. Employees (Conduct) Rules,1966, vide which a Govt employee cannot associate with any Political Party.

Ques 2316. The son of a Govt. employee joined militancy Group. Comment?

Ans 2316.  Vide rule 5(2) of the Pb. Govt. Employees (Conduct) Rules, 1966, it is the duty of every Govt. employee to prevent members of his family from taking part in subversive movements. In case he is unable to prevent the members of his family from taking part in such movements, he should make a report to that effect to the Govt. As such the employee should report the facts to the Govt.

Ques 2317. The son of a Govt. employee joined the Sikh Students Federation. He did not inform the Govt. on the grounds that it is not political party. Who will decide whether or not such an organization is political or not and whether the activities of the Organization are subversive of the Govt.?

Ans 2317. Vide rule 5(3) of the Pb. Govt. Employees (Conduct) Rules,1966, government will decide the matter & its decision will be final.

Ques 2318. A Govt. employee was convassing and using his influence in favour of a candidate of a Political Party for election to the state legislature. Comments?

Ans 2318. The action of the Govt. employee was against the provisions of the rule 5(4) of the Pb. Govt. Employees (Conduct) Rules,1966, vide which a Govt. employee cannot convass or use his influence in connection with election to the legislature or local authority.

Ques 2319. In the election to the Punjab Vidhan Sabha, a patwari acted as a polling agent of a candidate fielded by a Political Party Comments?

Ans 2319. The action of the patwari is against the provisions of the rule 5(4) of the Pb . Govt. Employees (Conduct) Rules,1966, vide which Govt. employee cannot act as polling agent of a party in an election to the legislature.

Ques 2320. A Govt. employee cast his vote in favour of a particular candidate and declared it loudly. Comments?

Ans 2320. The action of the Govt employer is against the provisions of the Proviso (to rule 5(4) of the Pb. Govt Employees (Conduct) Rules 1966. Vide which Govt employee cannot give indications to which candidate he has cast his vote.

Ques 2321. A Govt. employee was posted as a polling officer in Vidhan sabha elections. Will it be considered as taking part in elections?

Ans 2321. The Proviso (ii) to rule 5(4) of the Po. Govt Employees (Conduct) Rules, 1966, lays down that official duty in elections does not considered to be as taking part in elections.
